Probate

A common misconception is that when a person passes away, the debt dies with them. This is not the case, the debt is a liability of the deceased estate. Our probate debt recovery service is designed to recover these debts.

A creditor has 6 months from the date of death to register their interest in a deceased estate.

An executor has a legal duty pursuant to the Administration of Estates Act 1925 to administer the estate according to the law.

Distribution of an estate's assets to beneficiaries prior to satisfying the debts of an estate can make the executor personally liable.

Often when a customer passes away, companies write off these debts because for reputational or other reasons they do not want to be seen to be pursuing debts with a grieving family, or they simply do not know that these debts can be recovered and that they are legally entitled to do so.

We have many years of experience in recovering debts from deceased estates, and have developed an approach which is respectful to the family of the deceased while also ensuring that your interest is registered in the estate.  We then make enquiries to determine whether or not an estate is solvent and the likelihood of payment in full.
